Documents needed for the TAPU or Title Deed

1. Documents asked by the TAPU office :

During the application , the buyers and the sellers are to provide the local TAPU office with the following documents:

a) THE BUYER :

1. passport of the buyer translted at the notary

2. Two recent passport photo's of the buyer sized 4cm x 6 cm

3.tax number

4. official map with exact location of the property from the Office of the Land Registry.

 

b) THE SELLER :

1.title deed of the property

2. passport

3.two recent passport photo's

4. earth quake insurence

5.Turkish Citizen number

6.tax number

2. Issuance of a new TAPU

Finally after the military clearence has been finished , you are given an official ownership document called TAPU

Without having a TAPU , you are never considered to legally own the property.

3. Declaration of acquisation to the local gouvernement.

You are supposed to apply to the municipality for declaring the acquisation of the peroperty by the end of the year of acquisation.

You simply fill out a form and submit it to the municipality. Afterwards , the municipality officers will tell you when and how much real estate tax you are going to pay.

Everything about the new tapu law

According to the article 35 of the title deeds law , foreign persons are able to acquire real estate in Turkey on the condition of being reciprocal and complying with legal restrictions.

1. Forbidden zone

Foreigners are not allowed to buy property in the military , strategic and security zones of Turkey.    In addition , the council of Ministers is authorized to determine specific zones to be preserved such as lands witch are strategically very important in terms of energy , agriculture , mining , history , cultural values , biological flora and national security. Foreigners will not be able to buy property in those specially preserved zones.

Upon your application , the local TAPU office will do a search on behalf of you , whether the asset is in a forbidden zone or not.

If the information provided by military authoroties confirms that the real estate is outside the military and security zones , then your application is accepted.                                                                 Please note that the military clearence may take a considerable time.

2. Size limitation

The total area foreigners can own in Turkey cannot exceed 2,5 hectares ( 25 000 m2).

The maximum size of all lands owned by foreigners in a town cannot exceed 10 % of the total area within the Imlementary Development plan and the Local Development plan of a town.
